These Terms of Service govern the rights, obligations, and responsibilities between EncorePlay (the "Company") and users regarding the use of the music lesson management service (the "Service").
1. Purpose
These Terms set forth the conditions and procedures for using the Service, as well as the rights, obligations, and responsibilities of the Company and its users.
2. Definitions
- "Service" means the music class, lesson, homework, and feedback management platform provided by the Company.
- "User" or "Member" means a person who has agreed to these Terms and uses the Service.
- "Teacher" means a member who runs music lessons. "Student" means a member who participates in lessons.
- "Pro Plan" means the paid subscription service priced at ₩9,900 per month.
3. Effect and Modification of Terms
- These Terms take effect when the user agrees during sign-up.
- The Company may amend these Terms within the limits of applicable law. Material changes will be announced in-app or by email at least 7 days before they take effect (30 days for substantial changes).
- If a member does not agree to the amended Terms, they may discontinue use by deleting their account.
4. Account Registration
- Registration is completed when an applicant agrees to these Terms and the Privacy Policy, applies through the procedure set by the Company, and the Company accepts the application.
- Persons aged 14 or older may register on their own behalf.
- Persons under the age of 14 must obtain consent from a legal guardian (e.g., a parent) and submit guardian contact information (such as email) for verification at registration.
- The Company may reject an application in cases such as: identity theft, false information, or applications made for the purpose of disturbing public order or morals.
5. Membership Withdrawal and Loss of Status
- Members may withdraw at any time directly from the in-app Profile page.
- If a member engages in any of the following acts, the Company may suspend or terminate the membership without prior notice: violation of these Terms, infringement of others' rights, fraudulent payment attempts, or interference with Service operations.
6. Service Provision
- The Company strives to provide the Service 24/7 year-round; however, the Service may be temporarily suspended due to system maintenance, failures, force majeure, etc.
- The Company may modify the Service for quality improvement, with prior notice.
7. Use of the Service and Prohibited Conduct
Members shall not engage in the following acts:
- Unauthorized use of others' personal information, accounts, or payment methods
- Infringement of the Company's or third parties' intellectual property rights
- Interference with normal operation of the Service (hacking, automation tools, abnormal traffic, etc.)
- Posting content that is obscene, violent, discriminatory, or otherwise contrary to public order
- Posting false information or deceiving other members
- Other acts that violate applicable law
8. Rights and Responsibilities for Content
- Copyright in content posted or uploaded by members (lesson records, homework, feedback, messages, attached files, etc.) belongs to the respective member.
- Members grant the Company a non-exclusive, royalty-free license to use, reproduce, and transmit such content for the purposes of operating, improving, and promoting (within the Service only) the Service.
- If member content infringes on the rights of others or violates applicable law, the posting member is solely responsible.
- The Company may delete or hide content that violates the law or these Terms, based on reports or its own judgment, without prior notice.
9. Obligations of the Company
- The Company complies with these Terms and applicable law, and strives to provide a stable Service.
- The Company manages members' personal information in accordance with the Privacy Policy.
- The Company strives to respond to members' opinions and inquiries within a reasonable period.
10. Limitation of Liability
- The Company is not liable for failure to provide the Service due to causes beyond its reasonable control, including force majeure, war, cyberattacks, or telecommunications failures.
- The Company does not guarantee the reliability or accuracy of content posted by members.
- The Company's liability under these Terms is limited to the extent permitted by applicable law.
11. Paid Service (Pro Plan)
- The Company offers paid services such as the Pro Plan. Pricing, payment methods, and feature differences are described separately.
- The Pro Plan is billed monthly on a recurring basis and renews automatically unless cancelled by the member.
- Payments are processed through Stripe; the Company does not directly retain payment information.
12. Refunds
Refund matters are governed by the separate Refund Policy.
13. Protection of Minors
- Members under the age of 14 may register only with consent from a legal guardian. The Company strives to provide a safe Service for minors.
- Legal guardians may, at any time, request registration, withdrawal of consent, access and correction of personal information, or account deletion on behalf of a minor member.
14. Dispute Resolution and Jurisdiction
- Disputes between the Company and members shall, in principle, be resolved through mutual consultation.
- If consultation is not reached, disputes shall be resolved in accordance with applicable laws including the Act on the Consumer Protection in Electronic Commerce, etc. and the Act on the Regulation of Terms and Conditions, etc.
- The court of jurisdiction for disputes regarding these Terms and use of the Service shall be the Seoul Central District Court.
15. Governing Law
These Terms and any disputes between the Company and members shall be interpreted and enforced in accordance with the laws of the Republic of Korea.
